Joint authorship of a copyrightable work is when two or more persons contribute enough to the work to be the author of that work. In the case of joint authorship, the authors share the copyright in the work with each other.

Die Autoren werden dabei untereinander als Koautor, Coautor, Co-Autor, Mitautor oder Miturheber bezeichnet. Im Bereich des Sachbuchs werden auch Ghostwriter als Co-Autoren bezeichnet. Der Begriff des Koautors wird insbesondere in der Wissenschaft verwendet, da wissenschaftliche Veröffentlichungen häufig von mehreren Personen angefertigt werden. Formell und urheberrechtlich bezieht sich die Urheberschaft auf das Verfassen des Textes. Es hat sich jedoch die äußerst umstrittene Praxis eingebürgert, auch Personen als Koautoren zu nennen, die keine Beteiligung am Entstehen des Textes selbst haben, sondern lediglich bei der Durchführung der beschriebenen Forschungsarbeit. In der Praxis ist es schwierig, den tatsächlichen individuellen Schreibanteil eines einzelnen Koautors zu bewerten, was in der Vergangenheit national und international bereits zu Wissenschaftsskandalen geführt hat. Oft kommt es vor, dass Professoren oder Leiter von Forschungsgruppen und -einrichtungen Mitautorenschaft für Werke ihrer Mitarbeiter und Studenten beanspruchen, obwohl sie keinen Teil der Publikation verfasst haben. Dies geht so weit, dass einige von ihnen sogar urheberrechtliche Ansprüche auf Diplomarbeiten geltend machen wollen (siehe Schutzrechtsberühmung). (de)

Lorsque la participation de chacun des coauteurs relève de genres différents, chacun peut, sauf convention contraire, exploiter séparément sa contribution personnelle, sans toutefois porter préjudice à l'exploitation de l’œuvre commune. De bons exemples en sont : la base de données OpenStreetMap ou les co-portraits photographiques réalisés par la comtesse de Castiglione avec le photographe-portraitiste Pierre-Louis Pierson : ou, plus récemment, tous les co-portraits réalisés par Jean-Louis Swiners.
