Capital punishment was abolished via the legislative process on May 2, 2013, in the U.S. state of Maryland. The death penalty had been in use in the state or, more precisely, its predecessor colony since June 20, 1638, when two men were hanged for piracy in St. Mary's County. A total of 309 people were executed by a variety of methods from 1638 to June 9, 1961, the last execution before Furman v. Georgia. Since that time, five people have been executed.

The "Death Row" for men was in the North Branch Correctional Institution in Western Maryland's Cumberland area. The execution chamber was in the Metropolitan Transition Center (the former Maryland Penitentiary). The five men who were on the State's "death row" were moved in June 2010 from the Maryland Correctional Adjustment Center. (en)

Avant son abolition en 2013, la peine de mort n'était pas autorisée en cas de retard mental de l'accusé. Le juge fixe la semaine où doit avoir lieu l'exécution (entre les 4 à 8 semaines suivantes), et le directeur de l'administration pénitentiaire la date exacte qui reste secrète jusqu'au dernier moment. Les exécutions ont lieu à Baltimore. Le gouverneur a seule autorité pour décider de la grâce. Ceux qui ont commis leur crime avant 1994 peuvent demander à être exécutés dans la chambre à gaz, mais ce n'est jamais arrivé. Le 24 juin 2009, l'administration a publié un nouveau protocole d'exécution qui attend d'être examiné par la législature et sujet aux commentaires publics avant de ne pouvoir être approuvé par le gouverneur.Aujourd'hui, le Maryland détient cinq personnes susceptibles d'être condamnées à mort.
