A construction contract is a mutual or legally binding agreement between two parties based on policies and conditions recorded in document form. Imam Soehanto (1995: 552) mendefinisikan kontrak konstruksi sebagai suatu proses dimana pemilik proyek membuat suatu ikatan dengan agen dengan tugas mengkoordinasikan seluruh kegiatan penyelenggaraan proyek termasuk studi kelayakan, desain, perencanaan, persiapan kontrak konstruksi dan lain-lain, kegiatan proyek dengan tujuan meminimkan biaya dan jadwal serta menjaga mutu proyek. Berdasarkan Pasal 1 UU No. 18/1999, disebutkan bahwa kontrak kerja konstruksi adalah keseluruhan dokumen yang mengatur hubungan hukum antara pengguna jasa dan penyedia jasa dalam penyelenggaraan pekerjaan konstruksi. Pada dasarnya, kontrak kerja konstruksi dibuat secara terpisah sesuai tahapan dalam pekerjaan konstruksi, yang terdiri dari kontrak kerja konstruksi untuk pekerjaan perencanaan, untuk pekerjaan pelaksanaan, dan untuk pekerjaan pengawasan.
