| - Freedom of education is the right for parents to have their children educated in accordance with their religious and other views, allowing groups to be able to educate children without being impeded by the nation state. Freedom of education is a constitutional (legal) concept that has been included in the European Convention on Human Rights, Protocol 1, Article 2, International Covenant on Economic, Social and Cultural Rights Article 13 and several national constitutions, e.g. the Belgian constitution (former article 17, now article 24) and the Dutch constitution (article 23). - La libertad de educación consiste en el derecho que poseen los padres y, por extensión, las comunidades locales, culturales o religiosas, de educar a los miembros de las nuevas generaciones en función de sus propias convicciones. Esto se relaciona con la llamada «libertad de enseñanza» entendida como la libertad de satisfacer las exigencias educativas impuestas por el Estado prefiriendo las formas que resulten más acordes a las propias convicciones. - La liberté d'éducation est le droit pour tout parent de choisir les orientations de l'éducation qui est donnée à ses enfants (Article 5 de la Convention internationale des Droits de l'Enfant - CIDE) : « L’État doit respecter les droits et responsabilités des parents et des membres de la famille élargie de guider l’enfant d’une manière qui corresponde au développement de ses capacités. » Ce droit implique la liberté de choisir le mode d'instruction pour son enfant entre les écoles publiques, privées sous-contrat ou hors contrat ou encore dans le cadre de l'instruction en famille. - De vrijheid van onderwijs is een recht op grond waarvan iedereen een school mag oprichten. Vrijheid van onderwijs betekent ook dat ouders voor hun kinderen mogen kiezen tussen openbare scholen, onderwijs dat is gebaseerd op een religieuze of levensbeschouwelijke visie (bijzonder onderwijs), en thuisonderwijs. In sommige landen is inschrijving in een openbaar of door de overheid gecontroleerd onderwijssysteem verplicht en hebben burgers niet het recht zelf een school op te richten. Uiteindelijk is de vrijheid van onderwijs bedoeld om onderwijsmonopolies te voorkomen. (nl)
