In der Folge arbeitete Carpenter wieder als Anwalt in Washington und Milwaukee, ehe er 1878 erneut in den Senat gewählt wurde. Er starb jedoch noch während seiner Amtszeit am 24. He served in the Senate from 1869 to 1875 and again from 1879 to 1881. Recognized as an authority on constitutional law, he made some of the most important legal arguments of 19th-century America. Carpenter presented cases before the U. S. Supreme Court involving such matters as states' rights and regulation of corporations. (en)

Han gick med i demokraterna och var distriktsåklagare för Rock County, Wisconsin 1850-1854. Han bytte senare parti till republikanerna. Carpenters grav finns på Forest Home Cemetery i Milwaukee. (sv)
